Acceptance of these Terms

By downloading, installing or using SmartSkies, you agree to these Terms of Use and Privacy Policy.

If you do not agree with these terms, you must stop using the application.

These terms apply to the SmartSkies mobile application, associated websites and related services operated by Twelve Technology Limited.

Terms of Use

Use of SmartSkies

SmartSkies is provided for your personal use to assist with flight planning, flight tracking, logbook management and other aviation-related services.

You agree to use SmartSkies only for lawful purposes and in accordance with these Terms.

You must not:

  • misuse or interfere with the operation of the service;
  • attempt to gain unauthorised access to any systems or accounts;
  • reverse engineer or modify the application except where permitted by law;
  • use automated tools to scrape or extract data without written permission.

Accounts

You are responsible for maintaining the confidentiality of your account credentials.

You must provide accurate information when creating your account.

You must notify us immediately if you believe your account has been accessed without your permission.

Software Licence

SmartSkies grants you a limited, non-exclusive, non-transferable licence to use the application for your personal use.

You may not:

  • copy or redistribute the application;
  • modify or create derivative works;
  • sell, lease or sublicense the application;
  • use the application in breach of applicable laws.

Intellectual Property

All software, content, trademarks, logos, graphics and intellectual property relating to SmartSkies remain the property of Twelve Technology Limited or its licensors.

Nothing in these Terms transfers ownership of any intellectual property to you.

Aviation Disclaimer

SmartSkies is not a certified navigation system.

The application is intended as a supplementary planning and record-keeping tool only.

Location information, maps, flight planning information, flight tracking information and other aviation data may contain inaccuracies or omissions.

You must always:

  • use official aeronautical publications;
  • comply with applicable aviation regulations;
  • use certified navigation equipment where required;
  • exercise your own judgement when conducting a flight.

You remain solely responsible for the safe operation of your aircraft.

Availability

We aim to keep SmartSkies available at all times but cannot guarantee uninterrupted availability.

Features may be modified, suspended or withdrawn without notice where necessary to improve, maintain or secure the service.

Third-Party Services

SmartSkies integrates with third-party services including mapping, authentication, hosting, analytics and notification providers.

We are not responsible for the availability or operation of third-party services.

Termination

We may suspend or terminate your account if:

  • you breach these Terms;
  • your use creates security risks;
  • required by law.

You may stop using SmartSkies at any time.

Disclaimer

SmartSkies is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Twelve Technology Limited excludes all warranties except those that cannot legally be excluded.

We do not guarantee that:

  • the service will always be available;
  • information provided will always be complete or accurate;
  • the service will be free from defects or interruptions.

Limitation of Liability

To the fullest extent permitted by law, Twelve Technology Limited shall not be liable for indirect, incidental, consequential or economic losses arising from use of SmartSkies.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or any liability that cannot legally be excluded.

Who We Are

SmartSkies is operated by Twelve Technology Limited.

Information We Collect

We may collect:

  • Account and profile information, including your name, email address, date of birth and home airfield.
  • Authentication information required to create and secure your account.
  • Aviation information, including pilot licences, ratings, medical details, aircraft information, flight plans, flight history and logbook records.
  • Precise location information, including latitude, longitude, altitude, speed and timestamps.
  • Device and usage information, including push notification tokens, app activity, analytics and diagnostic information.
  • Information you provide when contacting support.

Location Information

SmartSkies collects precise location, altitude, speed and timestamps when you start flight tracking.

With your permission, SmartSkies continues collecting location data in the background, including when the app is closed or not in use.

This enables:

  • live flight tracking;
  • recording your flight route;
  • creating flight and logbook records;
  • displaying your route on maps;
  • providing relevant airfield notifications.

Location information is not used for advertising.

You can disable location access through your device settings, although some features may no longer function correctly.

How We Use Your Information

We use your information to:

  • create and manage your account;
  • authenticate users;
  • provide flight planning and tracking;
  • maintain pilot, aircraft and logbook records;
  • display flight routes and maps;
  • send notifications;
  • provide customer support;
  • detect faults and improve reliability;
  • comply with legal and regulatory obligations.

How We Share Information

We use trusted service providers including:

  • AWS
  • Auth0
  • Mapbox
  • Segment
  • Mixpanel
  • Expo
  • Google Firebase
  • Firebase Cloud Messaging

These providers process information only as necessary to provide SmartSkies services.

We do not sell personal information or location information.

We do not use location information for targeted advertising.

We may disclose information where required by law or to prevent fraud or protect safety.

Data Retention

Personal information, account information and flight records are retained while your account remains active and where necessary to provide flight history and logbook functionality.

When your account is deleted, personal information will be deleted or anonymised unless retention is required for legal, regulatory, aviation safety or fraud prevention purposes.

Account and Data Deletion

You can delete your account by:

  1. Opening SmartSkies.
  2. Selecting Settings.
  3. Choosing Delete Account.
  4. Confirming deletion.

If you cannot access the application, email help@smartskies.app from your registered email address using the subject:

Delete my SmartSkies account

Include your full name.

Security

We use reasonable technical and organisational measures to protect personal information.

Information is transmitted using encrypted connections and access is restricted to authorised personnel and trusted service providers.

No internet-based service can guarantee absolute security.

Your Rights

Depending on your location, you may have the right to:

  • access your information;
  • correct inaccurate information;
  • request deletion;
  • restrict or object to processing;
  • receive a copy of your information;
  • withdraw consent where applicable.

Children

SmartSkies is not intended for children who are not legally permitted to create an account without the involvement and consent of a parent or guardian.

We may update these Terms and this Privacy Policy from time to time.

The latest version will always be available within the SmartSkies website and application.
